A Briefing on the Families First Coronavirus Response Act (FFCRA)

There has been much activity over the past weeks related to COVID-19, including support from our nation at both individual and organizational levels. One of the recently passed pieces of legislation includes the Families First Coronavirus Response Act (FFCRA). This act provides employees with support in the event they are unable to work due to a COVID-19 related situation. It includes two components — emergency paid sick leave and expanded family and medical leave — for specified reasons related to COVID-19. FFCRA (including the paid sick leave component) went into effect as of April 1 and extends through December 31, 2020.

The following are the qualifiers for an employee to receive pay due to COVID-19 under the act:

  1. The employee is subject to a Federal, State, or local quarantine or isolation order relative to COVID-19;
  2. has been advised by a health care provider to self-quarantine related to COVID-19;
  3. is experiencing COVID-19 symptoms and is seeking a medical diagnosis;
  4. is caring for an individual subject to an order described in (1) or self-quarantine as described in (2);
  5. is caring for his or her children whose school or place of care is closed (or childcare provider is unavailable) due to COVID-19 related reasons; or
  6. is experiencing any other substantially similar condition specified by the U.S. Department of Health and Human Services.
